These Arlettie Membership Terms and Enrollment Notice ("Membership Terms") apply to your purchase, enrollment in, and use of an Arlettie membership ("Membership"). These Membership Terms supplement Arlettie's Terms of Use, Terms of Sale, and Privacy Policy.

By purchasing, enrolling in, or using the Membership, you agree to these Membership Terms, Arlettie's Terms of Use, Terms of Sale, and Privacy Policy. If there is a conflict between these Membership Terms and Arlettie's Terms of Use or Terms of Sale with respect to the Membership, these Membership Terms will control solely with respect to the Membership.

Article 1 – Definition of Membership

"Membership" means the paid annual Arlettie membership program purchased by a customer, which provides eligible members with access to the benefits described at the time of purchase, including any applicable early access, priority access, preview access, showroom, private sale, or other benefits offered by Arlettie from time to time, subject to these Membership Terms, Arlettie's Terms of Use, Terms of Sale, and Privacy Policy.

Article 2 – Membership Overview

The Membership provides eligible members with access to certain benefits related to Arlettie's private sales, showroom events, online sales, and other services during the applicable Membership term, subject to these Membership Terms and Arlettie's Terms of Use, Terms of Sale, and Privacy Policy. Arlettie is a showroom and private-sale business offering discounted products, including fashion, accessories, and other products from participating brands.

This Membership is valid solely for Arlettie events, showrooms, and online sales operated in the United States. It does not confer any rights, access, benefits, or discounts with respect to Arlettie showrooms, events, or sales operated in Europe or any other jurisdiction outside the United States.

The Membership is intended for personal, non-commercial use only. It is not available for resale, personal shopping, brokerage, commercial sourcing, inventory acquisition, or any other commercial purchasing activity.

Article 3 – Membership Price

The current Membership price is displayed on the Arlettie website at the time of enrollment, as well as during the payment process and in the enrollment confirmation email, plus any applicable taxes or fees. Arlettie reserves the right to modify the Membership price for future renewal terms or future Membership purchases. If required by applicable law, Arlettie will provide notice of any material price change before charging you for a renewal term.

Article 4 – Membership Term

The initial Membership term is one (1) year beginning on the date your Membership is purchased and accepted by Arlettie.

Unless you cancel before renewal, your Membership will automatically renew for additional one-year terms at the then-current Membership price, plus applicable taxes and fees, as disclosed to you before renewal where required by law.

Article 5 – Automatic Renewal Disclosure and Consent

By purchasing the Membership, you authorize Arlettie or its payment processor to charge your selected payment method for the initial annual Membership fee and, unless you cancel, for each renewal term. Before you complete your purchase, Arlettie will disclose the Membership price, renewal term, cancellation method, and other material renewal terms. By completing the purchase, you consent to the automatic renewal of the Membership and to recurring annual charges unless you cancel.

This automatic renewal provision is intended to comply with applicable federal and state automatic renewal, negative option, and consumer protection laws, including applicable New York automatic renewal requirements. Arlettie will use a conservative compliance approach by making cancellation clear, simple, and reasonably accessible, and by complying with applicable state automatic-renewal laws.

Article 6 – Membership Benefits

Subject to these Membership Terms, availability, event capacity, brand-partner requirements, operational constraints, and applicable law, Membership benefits may include:

  • Early access or priority access to open sales, subject to the conditions of each event;
  • Access to all additional discounts applied on a selection of sales;
  • Other exceptional and temporary services made available on a selection of sales from time to time, at Arlettie's sole discretion, which do not constitute a guaranteed or recurring benefit;
  • Access to selected member communications, invitations, or promotions;
  • Other benefits that Arlettie may offer from time to time.

Membership benefits are not guaranteed for every sale, brand, event, date, showroom, online sale, or product category. Benefits may vary by event, location, product category, brand partner, operational constraints, capacity limits, and applicable law.

Membership benefits are personal to you and to you alone. Only the Membership holder may benefit from Membership privileges. They may not be transferred, shared, assigned, resold, or used for commercial purposes. Sharing login credentials, invitations, or any other means of access with a third party so that such third party may benefit from Membership privileges constitutes a breach of these Membership Terms and may result in suspension, revocation, or termination of the Membership.

Arlettie may modify, suspend, substitute, or discontinue Membership benefits at any time, provided that Arlettie will not materially reduce paid Membership benefits in a manner prohibited by applicable law.

Article 7 – Eligibility

The Membership is generally available only to individuals who meet Arlettie's eligibility requirements and who purchase and use Arlettie products and services for personal, non-commercial purposes, except where Arlettie determines that a person is not eligible due to resale activity, suspected resale activity, purchasing patterns inconsistent with personal use, fraud, theft, inappropriate showroom conduct, security incidents, violation of Arlettie rules, or other lawful grounds. Arlettie may determine Membership eligibility based on information available to Arlettie, including account information, membership application or enrollment information, purchase history, event attendance, showroom conduct, return activity, payment disputes, chargebacks, fraud indicators, security incidents, and other lawful criteria.

Membership eligibility criteria are intended to protect Arlettie, its customers, its employees, its venues, and its brand partners, and to preserve the private-sale nature of Arlettie's events.

Article 8 – Resale and Prohibited Commercial Activity

Products purchased through Arlettie sales, events, online channels, or Membership benefits are for personal, non-commercial use only.

You may not:

  • Resell, broker, transfer, export, or commercially distribute products purchased through Arlettie;
  • Purchase products on behalf of resellers, personal shoppers, brokers, or commercial buyers;
  • Use the Membership to source inventory for resale;
  • Use multiple accounts, coordinated accounts, or other methods to circumvent quantity limits or access restrictions;
  • Use bots, automation, scraping tools, unauthorized purchasing tools, or similar methods;
  • Film, livestream, or photograph products or showroom activity for personal-shopping, resale, commercial, or other unauthorized purposes;
  • Engage in conduct inconsistent with Arlettie's personal-use purchasing policy.

Resale or attempted resale is grounds for refusal, suspension, revocation, termination, non-renewal, and/or exclusion from Membership, events, showrooms, online sales, and other Arlettie services.

Article 9 – Reseller Indicators and Purchasing Patterns

Arlettie may consider objective purchasing behavior and related conduct when determining whether a customer is eligible for Membership or whether a customer's Membership should be suspended, revoked, terminated, or not renewed, or whether a customer should be excluded.

Such indicators may include, without limitation:

  • Purchasing more than a permitted number of items during a sale;
  • Purchasing multiple units of the same SKU or substantially similar products;
  • Repeated high-volume purchasing across sales or events;
  • Targeting products or brands known to have high resale value;
  • Using carts, bags, or other methods suggesting bulk purchasing inconsistent with personal use;
  • Filming, livestreaming, photographing, or otherwise capturing or sharing showroom activity, online sale pages, product listings, pricing information, or other sale content, whether in person or online, in a manner consistent with personal shopping, resale, or any other unauthorized purpose;
  • Coordinating purchases with other customers, accounts, or groups;
  • Repeated chargebacks, payment disputes, return abuse, or suspected fraud;
  • Conduct suggesting that purchases are being made for resale, brokerage, export, or commercial distribution.

These indicators are not exhaustive. Arlettie may consider the totality of the circumstances and may update its internal eligibility and enforcement criteria from time to time.

Article 10 – Refusal, Suspension, Revocation, Termination, and Exclusion

To the fullest extent permitted by applicable law, Arlettie reserves the right to refuse, suspend, revoke, terminate, or decline to renew any Membership, and to restrict or exclude any person from Arlettie sales, events, showrooms, online sales, accounts, memberships, subscriptions, invitations, or other services, on a temporary or permanent basis, locally, regionally, or nationally, where Arlettie determines or reasonably suspects that such action is lawful and appropriate.

Grounds may include:

  • Resale or suspected resale;
  • Purchasing patterns inconsistent with personal use;
  • Violation of quantity limits or SKU limits;
  • Fraud, attempted fraud, theft, or suspected theft;
  • Abusive, threatening, unsafe, disruptive, or inappropriate showroom conduct;
  • Violation of showroom rules or event rules;
  • Unauthorized photography, filming, livestreaming, or personal-shopping activity;
  • Chargebacks, payment disputes, nonpayment, or payment fraud;
  • Use of false, inaccurate, incomplete, or misleading account information;
  • Circumvention of access controls, eligibility criteria, or security measures;
  • Violation of brand-partner requirements;
  • Violation of Arlettie's Terms of Use, Terms of Sale, Privacy Policy, or these Membership Terms;
  • Conduct that may harm Arlettie, its customers, its employees, its venues, its brand partners, or the integrity of Arlettie's private sales.

Arlettie may apply these restrictions to Membership access only or, where appropriate and lawful, to broader access to Arlettie events, showrooms, online sales, and services.

Any exclusion, suspension, revocation, or termination of a Membership, whether temporary or permanent, shall render the affected individual ineligible for Membership and for participation in Arlettie sales, events, showrooms, online sales, and other services in all countries and jurisdictions in which Arlettie operates, unless Arlettie expressly determines otherwise in writing. A person who has been excluded or whose Membership has been terminated for cause shall not be permitted to re-enroll in any Arlettie membership program, in any country, without Arlettie's prior written authorization.

Article 11 – No Discrimination

Arlettie's decisions regarding Membership eligibility, refusal, suspension, revocation, termination, non-renewal, or exclusion are based on lawful business, security, operational, fraud-prevention, brand-protection, and conduct-related criteria. Arlettie does not make such decisions based on race, color, ethnicity, national origin, ancestry, religion, creed, sex, sexual orientation, gender, gender identity or expression, disability, age, citizenship, marital status, military or veteran status, genetic information, weight and/or height, or any other characteristic protected by applicable law.

Article 12 – Cancellation by Member

You may cancel your Membership by logging into your Arlettie account and following the cancellation instructions, by using the cancellation link or contact form made available on the Arlettie website, or by using any other cancellation method disclosed by Arlettie at enrollment.

If you enrolled online, Arlettie will provide an online cancellation method that is easy to find and use, to the extent required by applicable law. If you enrolled in person at a showroom, Arlettie will provide a cancellation method that is clearly disclosed at enrollment and reasonably accessible.

Cancellation will stop future renewal charges and prevent the Membership from renewing for a new annual term. Unless otherwise stated at the time of purchase or required by applicable law, cancellation does not automatically result in a refund of amounts already paid for the current Membership term.

Article 13 – Refund Policy

Unless otherwise required by applicable law or expressly stated by Arlettie at the time of purchase, Membership fees are non-refundable once the Membership is purchased, except where expressly approved by Arlettie in its discretion.

If you cancel, your Membership benefits will continue until the end of the then-current paid annual term, and you will not be charged for the next renewal term. If Arlettie elects to offer a prorated refund, the refund may be calculated based on the unused portion of the current Membership term, less any amounts permitted by applicable law or disclosed at purchase.

Arlettie may refuse a refund where the Membership has been suspended, revoked, or terminated because of resale, suspected resale, fraud, theft, misconduct, abuse, chargebacks, payment disputes, security concerns, violation of these Membership Terms, or violation of Arlettie's Terms of Use, Terms of Sale, Privacy Policy, showroom rules, event rules, brand-partner requirements, or applicable law.

Article 14 – Cancellation or Termination by Arlettie

Arlettie may suspend, revoke, terminate, or decline to renew your Membership if Arlettie determines or reasonably suspects that you have violated these Membership Terms, the Terms of Use, the Terms of Sale, the Privacy Policy, showroom rules, event rules, brand-partner requirements, or applicable law.

If Arlettie terminates your Membership for resale, suspected resale, fraud, theft, misconduct, abuse, chargebacks, payment disputes, security concerns, or other violation, you may lose access to Membership benefits immediately. In such cases, Arlettie may deny a refund to the fullest extent permitted by applicable law.

If Arlettie terminates your Membership without cause, Arlettie may provide a prorated refund for the unused portion of the Membership term unless otherwise required by applicable law.

Article 15 – In-Showroom Enrollment

If you purchase the Membership in person at an Arlettie showroom, you will be provided with these Membership Terms, or a paper or electronic enrollment form that includes the material Membership terms and automatic-renewal disclosures.

By signing the enrollment form or otherwise completing the purchase, you acknowledge and agree that:

  • You have received or had access to these Membership Terms;
  • You accept Arlettie's Terms of Use, Terms of Sale, and Privacy Policy;
  • The Membership automatically renews annually unless cancelled;
  • You authorize recurring annual charges unless you cancel;
  • Resale is prohibited;
  • Arlettie may refuse, suspend, revoke, terminate, or decline to renew Membership for the reasons described in these Membership Terms.

A Membership sold at Arlettie's regular showroom is not subject to any three-day cancellation period solely because the purchase was made in person at the showroom, unless applicable law requires otherwise.

Article 16 – Privacy and Use of Information

Arlettie may use information about you to administer the Membership, process enrollment and renewals, determine eligibility, prevent resale, detect fraud, enforce showroom and event rules, protect Arlettie and its brand partners, process payments, provide benefits, communicate with you, and comply with applicable law.

This information may include account information, purchase history, event attendance, payment information, return activity, chargeback history, customer service communications, showroom incident records, security information, and other information described in Arlettie's Privacy Policy.

Please review Arlettie's Privacy Policy for more information about how Arlettie collects, uses, discloses, retains, and protects personal information, and how you may exercise privacy rights available under applicable law.

Article 17 – Changes to Membership Terms

Arlettie may update these Membership Terms from time to time. If required by applicable law, Arlettie will provide notice of material changes before they take effect. Changes will not affect your right to cancel future renewal charges.
